$750,000 Jury Verdict for Our Deserving Client on UIM Claim

A jury has just returned a $750,000 verdict against State Farm – 30 times more than what the insurance company offered to pay to its own customer.

The customer did the responsible thing by purchasing $50,000 in uninsured motorist coverage. She was stopped at a red light and injured in a multi-car crash caused by a negligent uninsured driver. So you would think her insurance company would pay her policy limits. Instead, they offered a fraction of the coverage she had been paying for, a fraction of what she was entitled to.

Her attorneys at the Law Firm of Pajcic & Pajcic had no choice but to go to trial. After four days of testimony, a Duval County jury awarded our client $750,000.

The accident happened in 2012 when our client’s Honda was totaled in the violent car accident in St. Augustine. She will need lifelong medical care for back, neck and knee injuries. She was counting on State Farm to be there if such an incident occurred.

State Farm was anything but a “Good Neighbor”! The insurance company hired a doctor to testify in court that she was not seriously injured in the collision and would not require any future medical care at all. The jury soundly rejected that testimony awarding her the full and fair amount of the damages sustained.

When State Farm first made an offer to our client, our attorneys made a reasonable counteroffer that was within the policy limits. State Farm rejected our offer so they will now be responsible for attorney’s fees and expenses for the trial which actually mean they will pay out approximately $1 million.

This verdict should be a reminder to State Farm and other insurance companies to do the right thing for their own customers. There is a reason we pay for insurance every month. We hope to never need it. But when the time comes and we are involved in a car accident, we expect to be paid what we are rightfully owed. We expect to be paid what we deserve. We are grateful the jury agreed.
